September Happenings around BC 9/18/2019

Dear Neighbors
Lots of good things happening around Beaver Creek. Check out the “Good Things” happening at Beaver Creek School. If you missed the Kids at Hope training held at school today, no worries. It will be held again in October.
The Yavapai County Board of Supervisors unanimously passed the zoning change request for the 8 acres across Beaver Creek Rd for the potential location of a shopping center with a grocery store. Stipulations requested by the Beaver Creek Community Association which will protect the community in the event that the project falls through were included. These were agreed to by the applicant. The Association reported that the request was in compliance with the community plan, Vision 2020, and with the majority of the community who commented in favor of the zoning change. However, this does NOT mean an immediate start on the project. First a design plan must be approved in conjunction with Development Services and Public Works that will include consideration for traffic circulation, drainage, soil composition, etc. The Dave Wingfield / Beaver Creek Rd intersection may well need some improvements. So probably nothing to see for quite a while.
The community plan was completed with the assistance of a mailed survey to every mailbox and route delivery address in Beaver Creek and to out of area property owners. Additionally, there were public meetings. It is a very important document describing our community. If you would like to read it, here is the link. Please disregard the word Draft at the top. This is the version that was accepted by the Yavapai County Board of Supervisors in 2011.
At 10 AM today in the BC Adult Center Kayo Parsons-Korn is presenting slides on Native Gardens and has some seeds to share.  On Saturday at 8 AM is a bird walk at Montezuma Well.  On Monday is the first meeting at 1 PM of the Lake Montezuma Women’s Civic Club at a new location and time.  And be prepared for the Spaghetti Dinner on Thursday and Oktoberfest on the following Saturday.

Special Events for Late September
Thursday, 9/26–The Beaver Creek Kiwanis Donation Spaghetti Dinner will be served from 5 to 7 PM at the Montezuma Rimrock Fire Station, 3240 E Beaver Creek Rd in Rimrock. Please come enjoy spending time with your neighbors and meeting some new folks, too.  The proceeds will benefit community projects in the MR Fire District. Event staff includes: Beaver Creek Kiwanis, Montezuma Rimrock Fire Station Personnel, Beaver Creek School K-Kids and Builders Clubs, and Sedona Sky students.
Saturday, 9/28-FEE FREE Day at all National Parks.
Saturday, 9/28-Free Smart Devices Help is available from 9 AM to Noon in the Beaver Creek Adult Center. Bring your tablet, smartphone and/or laptop and get the help you need. The instructor is Wendy Cook-Roberts. She has been doing a monthly class at the Camp Verde Library for about a year and has offered to also do one at BCAC. Wendy is proficient with iPhones, Android devices, Chromebooks and most Windows computers. She says, “What I don’t know I can find out and I am not afraid to say, ‘let’s look that up'”.
Saturday, 9/28-The Oktoberfest is being held from 10 AM to 2 PM at Rollins Park in Lake Montezuma. The Grace Lutheran Community Church is providing free brats, hot dogs and drinks and more. The Beaver Creek Trails Coalition is offering free snow cones and wristbands. Sedona Sky girls are doing face painting and games. There is a car show, live music, and trails information. Regularly Scheduled Meetings & Activities in Late September
Friday, 9/20–The BC Preservation & Historical Society meets at 10 AM in the Beaver Creek Adult Center Library.  The presentation this month will be from Kayo Parsons-Korn on Growing Your Own Native Garden. Saturday, 9/21–Bird Walks at Montezuma Well will be hosted by NPS from 8 AM to 10 AM this Saturday and then from 9 AM to 11 AM on the first and third Saturdays from October through March and back to 8 AM to 10 AM for April & May.  Meet at the Montezuma Well picnic area.  For more information please contact NPS at 928-567-3322, ext 0. Monday, 9/23–The Lake Montezuma Women’s Civic Club meets in the BC Adult Center main room from 1 PM to 3 PM.  We invite you to join us! New date, location, time and cost!  The first monthly meeting of the new year will be Monday, September 23 from 1 to 3 pm at the Beaver Creek Adult Center, 4250 E Zuni Way, Lake Montezuma.  Meetings are only $5 this year and annual dues remain $15.  This meeting will be a business meeting so please plan to attend.  Our purpose is to promote friendship, aid our neighbors and assist civic activities in our community.  Everyone is welcome.  Contact Bonnie Best at 510-761-0439 for more information.

Wednesday, 9/25-The Rimrock Farmers Market offers fresh produce, baked & canned goods, plants, artwork & crafts, eggs, and more from 4 to 7 PM every Wednesday evening at the Verde Valley Honey store, 3100 E Beaver Creek Rd. Wednesdays, All-The Al-Anon Family Group meets every Wednesday from 6 PM to 7 PM at the Beaver Creek Baptist Church (entrance is the same as to the Rimrock Post Office). Are you troubled by someone else’s drinking? This is a fellowship of relatives and friends of alcoholics who share their experience, strength and hope in order to solve their common problem.

Monday, 9/30–The Beaver Creek School Governing Board meets at 6:00 PM in the school board room.  The board also will meet this month on 9/30. The agenda will be posted at several sites locally and is also at: www.bcs.k12.az.us
The Good Things Happening in the Beaver Creek School District – September 2019
The Friday Enrichment Program is filled to capacity with a wait list. It is being funded by Tax Credit. Please consider donating to this fun and enriching program.
*        The Volleyball A Team remains undefeated with fantastic pair of coaches, Jesica Kramme and Micca Martinez
*        Coach Jeff Clarke leads the Cross County with Rodrigo Herrera Arriza and another student taking several first places!
*        ASU staff came and worked with teachers on Fitness Activities for their classrooms, as a refresher from a past grant. Teachers were given an opportunity to choose fitness materials for their rooms.
*        The fourth grade had a water conservation speaker from Project Wet in their classrooms for 3 days.
*        NWEA assessments have been completed, allowing teachers to see where student are academically at the beginning of the year, set goals with students, and measure growth throughout the year.
*        The Community Youth and Families committee has met twice and is supporting the mission of Beaver Creek School District staff to go forward with school-based mentoring. Classes on Kids at Hope and Mentoring begin this month.
 
*        And our bus has arrived from the VW settlement and school capital funds. The settlement brought in $1100, 000. The district added the $30799.16

Primrose Peaks Public Meeting held 8/17/2019

On Saturday, August 17, 2019, the Primrose Peaks public meeting was held by BCCA at the Beaver Creek School. Over 200 people attended, and many spoke about their concerns and issues with the proposed development. Residents were overwhelmingly negative to the proposal.

Dear Neighbors
 
There seems to be some misunderstanding of the Public Participation process of notification concerning potential zoning change requests.  
The potential applicant is required to notify property owners within 1000 ft if the acreage is one acre or more and also the community association about a participation meeting.  The community association (BCCA) usually broadcasts this information much farther so that others who are interested will be aware of the potential zoning change and often sets up the meetings to make sure that they happen.  In the case of Primrose, the meeting notice was mailed to residents by the applicant, was in a detailed Bill Helm Bugle article and twice in the Beaver Creek eNews.  All of which led to the venue being too small.  So the do over meeting is scheduled for:
Saturday, 8/17, at 3 PM in the Beaver Creek School Multipurpose Room. 
 
There is a sequence in the zoning change process that is followed by Yavapai County.  After the public meeting, the applicant must submit a report to Development Services.  If the process is continued, then the zoning change request will be scheduled on the agenda of a Yavapai County Planning and Zoning Committee meeting. (At this point an orange sign with the meeting date should appear on the property.)  Additional comments from the public and organizations may be made at this time.  The P&Z Committee will vote on a recommendation to the YC Board of Supervisors.  The BOS will then hear the applicant and the public again and make a final decision.  Some informative reading on this subject is on pages 20-22 of the Yavapai Planning and Zoning Ordinance for Unincorporated which is at the County web site.
The current petition is a great way to let your feelings on this issue be known.  Copies to the applicant, to Development Services and for the Planning and Zoning Commission may be of benefit to the signers.  Written comments may be presented at the meetings and online at Planning@yavapai.us

Please join us for the meeting which starts at 3 PM in the Adult Center. If you can’t make the meeting, please send us your comments particularly on the zoning change proposal to create RV storage on the 4 acres at the corner of Montezuma Lake Rd and Lookout Point Rd and/or land use violations.
 
For 20 to 30 minutes at the beginning of the meeting,  Rebecca Borowski, Yavapai County Land Use Unit Manager will explain what is and is not a violation and how to report violations to the county.  She will use a PowerPoint presentation to illustrate what is and is not a violation.

  • LMPOA will host the District 2 Community Meeting held by Tom Thurman on Saturday, 8/13 at 10 AM in the BC Adult Center. The 5-year road plan is the special topic of the meeting.
  • Call for Public Discussion Items.  Discussion with residents.

Land Use Violations:

To report a land use violation just dial the number below. Please describe the nature of the violation and the physical address or parcel number. You do not have to give your name if you wish to remain anonymous. The County does not actively patrol for violations and only investigates complaints it receives on the land use complaint hotline.

A Summary of Land Use Violations and How to Report Them

 

What is a Land Use Violation?

 

Outside Storage

  • Vehicular parts
  • Appliances (unless in use)
  • Furniture not designed for outside use
  • Commercial equipment
  • Debris
  • Disabled or junk vehicles

Use Violations

  • Non-permitted businesses
  • Living in a travel trailer over 90 days a year
  • Multi-family in single family zones
  • Excessive lighting
  • Excessive livestock

Permit Violations

  • All new construction over $1,000.00 in value requires a zoning clearance
  • Structures not requiring a permit must still meet use and setback requirements
  • Work in Flood Plane requires permits
  • Most grading requires permits

Weeds and Trash

  • Excessive weeds causing a fire hazard may be addressed if the Fire Department of jurisdiction deems them a hazard

Other Violations

  • The Land Use Unit also handles the administrative abatement of failed septic systems, dangerous buildings, building code violations and flood control violations.

What is Not a Violation

  • Ugly or excessive vehicles
  • Barking dogs
  • Social nuisances or noisy activities
  • Violations of Deed Restrictions
  • Cars parked in Rights of Way
  • Weeds in ditches along Rights of Way

The Abatement Process

  • Complaint received and assigned to specialist
  • Property researched
  • Inspection performed
  • Violation verified (if applicable)
  • Property owner or occupant notifiedNotice of Violation served
  • Hearing scheduled
  • Determination by the Hearing Officer
  • Judgment generated
  • Compliance monitored
  • Appropriate referrals if warranted (Superior or Criminal Court)

Potential Penalties

  • Immediate administrative fine of $100.00
  • Typical fine of $750.00 if not in compliance with judgment within specified time frame
  • All fines are collected by either staff or collection agency
  • Judgment is recorded against property until resolved

How To Report A Land Use Violation

Reporting a possible land use violation is easy and only requires a call to the Yavapai County land use violation hot line, anonymously if you wish. To speed along the abatement process please provide a street address and parcel number. Most reported violations are investigated within ten days.
